Data protection

I process personal data in accordance with the Swiss Data Protection Act (Datenschutzgesetz, DSG) and the European General Data Protection Regulation (GDPR).

​2. Processed personal data and purposes of processing

​

I generally process the following personal data when representing clients:

​​

  • Client data and data used for management of the representation: first and last name as well as contact information of data subjects, position and title, associated company/office, branch, any interrelationships (such as shareholders or related parties) and other background information from publicly available sources (such as the Commercial Register), anyone making a referral, the content of the inquiry and representation, opposing parties and their representatives, and additional information needed to examine any conflicts of interest

  • Data about a representation: communication with the client, courts, opposing counsel and third parties, advisory documentation, information disclosed to me by or for the client in connection with my services by opposing parties, courts, officials, and other participants in the proceedings or that I generate in the context of providing my services

  • Service and accounting data: information about services that have been provided and invoiced, invoice data, documentation of services, invoices, payments, banking information

​

  • Supplemental information: additional information provided to me by the client

​

I primarily process personal data to provide, document, invoice for and improve my services. This includes processing in fulfilment of legal requirements (such as to examine any conflicts of interest) and to assert or avert legal claims. I also process the personal data of my clients in order to be able to communicate with them, respond to inquiries and provide them with information on and issue invitations to courses or other events.

The provided personal data may be stored in a customer relationship management (CRM) or comparable inquiry organisation system. It will be stored for the duration of the business relationship and generally for ten years thereafter.

3. Disclosure of personal data

​

I do not disclose the personal data or consent of the data subject to third parties except in connection with work done for the client or when necessary for the purposes set forth in this data protection notice. In particular, information may be disclosed to courts and officials, opposing parties, corresponding lawyers, legal expense insurers, and other experts in connection with work done for the client.

I may also disclose personal data to contract data processing companies, in particular IT service providers and other providers that make IT applications available (such as collaboration platforms) or offer support and other services as instructed by me for the purposes set forth in this data protection notice.

4. Processing of personal data in connection with the website

​

4.1 Server log files

Every time the website www.schoenmannlaw.ch (referred to below as the website) is accessed, the system automatically records data and information from the computer system accessing it. The following data is collected at that time:

​

  • Information about the browser type and the version being used

  • The user’s operating system

  • The user’s Internet service provider

  • The user’s IP address

  • Date and time of access

  • Websites from which the user’s system accesses the website

  • Websites that the user accesses via the website

Information of this kind, which may also represent personal data, is stored in server log files. This information is needed to make the website user-friendly and reliable, and to ensure data security and therefore in particular the protection of personal data – including by third parties or with the help of third parties.

4.2 Cookies

The website uses cookies. Cookies are small files that are stored on your internal storage in order to understand information about interactions and the use of the website. For example, cookies are used for security reasons or to make the website more user-friendly.

The following data is stored and transmitted in the cookies:

  • Language settings

  • Login information

If you do not wish to use cookies, you can change the settings in your web browser to block cookies from the website. Cookies that have already been stored can be deleted at any time. If cookies for the website are deactivated, it is possible that not all of its functions can be used to their full extent.

4.3 Third-party services

The following tools are used on the website:

4.3.1 Google Analytics

The website uses Google Analytics. This is a service of Google LLC (referred to below as service provider) having its headquarters in the United States (www.google.com), which can measure and analyse use of the website (not personally identifiable). Permanent cookies set by the service provider are used for this purpose. The service provider does not receive any personal data from me, but it may track your use of the website and combine that information with data from other websites you have visited that are also tracked by the service provider, and then use that information for its own purposes (such as targeted advertising). If you have registered with the service provider yourself, the service provider also recognises you. Your personal data is then processed by the service provider subject to its responsibility according to its own data protection provisions. The service provider informs me only about how the individual website is used (no information about you personally).

4.3.2 LinkedIn

LinkedIn services and plugins are used to allow the social media platform’s functions and content to be embedded, and to allow the sharing of content on LinkedIn and on other channels.

5. Data subjects’ rights

​

People whose data I process have the right to request information pursuant to Article 8 of the Federal Data Protection Act of 19 June 1992 or, after its entry into force, pursuant to Article 25 of the Federal Data Protection Act of 25 September 2020.

To the extent processing is based on consent, every data subject has the right to withdraw that consent at any time with effect for the future.

​

People whose data I process may also assert additional rights pursuant to the applicable Swiss Data Protection Act (for example, after its entry into force, the right to data disclosure or transmission pursuant to Article 28 of the Federal Data Protection Act of 25 September 2020).

​

The data subjects may contact me to exercise their rights. I will process the requests in accordance with the applicable Swiss Data Protection Act. If I fulfil such a request only to a limited extent or refuse to fulfil it, I will provide justification for that in reference to the Act.

A data subject also has the option of contacting the Swiss Federal Data Protection and Information Commissioner (www.edoeb.admin.ch) as specified in the Data Protection Act.

6. Data security

​

I take technical and organisational measures to protect your data against manipulation, loss, destruction or unauthorized access by third parties. The SSL encryption process is used when the website is accessed.

7. Amendments to this data protection notice

​

It may be that amendments to this data protection notice are necessary from time to time, for example when there are changes in the Act or to the way I process personal data. The respective current version published on this website applies.
